Wage & Hour Rights and Responsibilities


Wage Payment: Employee rights include:- Spend for all earnings made (INFO # 3) at the rate agreed to by the company and employee.

- Pay of at least base pay (INFO # 1), the applicable Colorado or local minimum wage, and all earned overtime salaries without impermissible reductions from their salaries;.

- Pay of all earned earnings without impermissible deductions (INFO # 16).


Labor employment Statutes, Rules, & Published Guidance


Statutes & Rules: DLSS imposes a number of Colorado's wage and hour and other types of labor statutes and labor guidelines, including the Colorado Wage Act, the Colorado Overtime and Minimum Pay Standards (" COMPS Order"), and the Equal Pay for Equal Work Act. Please go to the Division's Labor Statutes and Labor Rules websites for existing and previous versions of essential Colorado labor statutes and guidelines.

Published Guidance: The Division's main types of public assistance are:- INFOs (Interpretive Notices and Formal Opinions) - the Division's formally approved notifications, viewpoints, and explanations on numerous labor law subjects; and.

- KNOWLEDGEs (Knowledge for Workers on Labor Law is Empowering & Drives Good Employment) one-page summaries for staff members on their labor rights.


Written Demands, Complaints, & Investigations


Demands & Complaints for Wages: If an employer owes you salaries, you can send your company a composed need for payment of wages by mail, e-mail, text, or other electronic ways. A written need might be sent out to the company at the very same time a Labor Standards Complaint Form for unsettled earnings is filed with the Division. The Labor Standards Complaint Form can be found on our Demands, Complaints, Responses, and Settlements website.

Employer Responses in Investigations: Once a complete Labor Standards Complaint Form is received and reviewed, a letter discussing the nature of the problem and the quantities declared to be owed is sent out to the employer. Investigations Launched by the Division (" Direct Investigations"): The Division may conduct employer-wide direct investigations of potential violations of Colorado wage and hour law. If you would like to send a tip, please email the Division at cdle_di_tips@state.co.us. If you want to file an individual claim for unpaid incomes, you need to complete a Labor Standards Complaint Form on our Demands, Complaints, Responses, and Settlements web page. To appeal a direct examination citation or one or more Notices of Assessment, an alleged employer may send a Direct Investigation Appeal Form.
